Real Estate and Legal Advice from a Single Source

Buying a home is the largest and most important financial decision for most people.  There are many aspects to a home purchase that involve the property, the contract, financing, and legal aspects relating to property ownership.

In order to meet the legal duty to a client under California law, a real estate professional must have knowledge about home construction, drafting the Purchase Agreement, negotiating skills, financing, and the escrow process.  Your agent must anticipate important facts such as the condition of the property and to assist its client in determining if the purchase may be completed within the client’s specific financial tolerance.  However, these obligations are just the beginning as there are legal aspects to the process that cannot, by law, be addressed by a real estate agent or his broker.

Legal aspects of a Purchase Agreement and other documents of sale goes beyond filling in, and checking off, the correct boxes.  It is critical that a buyer and seller understand the legal significance of what is being written down, and their rights if something goes wrong.  Things as simple as whether to sign a Liquidated Damages clause or agreeing to an Arbitration clause have legal significance about which a real estate agent cannot advise its client.  The process in which a counteroffer is proposed may mean that the initial offer is terminated and cannot withdrawn to reinstate the prior “agreement.”  These may seem simple however they may have significant future effect.  

Legal considerations should also include the method of holding title and whether the purchasers should have an estate plan.  The method of holding title is critical to the disposition of the home should one of the owners be incapacitated.  A properly drawn estate plan will determine how real property, and other property, will be distributed to your heirs.

Home purchasers should always consult with a qualified attorney regarding the legal significance of this important decision.
